Who benefits from the scandalous Law 5655?
On December 13, 2022, the Law “On Amendments to Certain Legislative Acts of Ukraine on Reforming the Sphere of Urban Development” was adopted.
The law is one of the steps in urban planning reform, designed to ensure the digitalization of all permitting procedures in construction and licensing of urban planning entities.
Under martial law, legal certainty of all concepts and clearly defined procedures are important.
Lawmakers tried to implement positive developments in the law, but there are a number of shortcomings.
In particular, the reduction of the role of state and local urban planning control and the creation of private State Architectural and Construction Inspections of Ukraine will allow developers to control themselves.
Simplification of the procedure for approval of urban planning documentation by the cultural heritage authorities may negatively affect construction within the historical areas of cities.
The law legalizes all unauthorized construction that was created before the law came into force.
Professional communities are discussing many other provisions of the law that, in their opinion, need to be improved.
We, as representatives of civil society and an organization that has been fighting illegal construction in Odesa for many years, certainly agree with most of the comments.
Nevertheless, we want to believe that Ukraine deserves the best legislation and equal and fair conditions for all participants of the urban planning process today.
Therefore, we appealed to the people’s deputies of Ukraine with a request to provide us with clarifications on the provisions of the law, which in our opinion require special attention. We are waiting for the answer and will inform you additionally.
